Copyright issues demand name-change BOAS

Copy- and film-rights issues will probably force Marvels Film to change the name of Martin Beek’s current film in production: Birth of a Song.

To prevent legal issues with the publisher of writer K. Duggal (Birth of a Song, 1991) and any film-rights owners, Karel Hamm, Aukje van Ginneken and Martin Beek are currently discussing the possibilities and the risks. They want to avoid any trouble, specially since Birth of a Song is a non-profit project.

Marvels Film are considering using the (Dutch) name “Vrije Val” (“free falling”) which is also the title of one of the songs in the movie.

The short 25 minute film (with the Aids Fund as beneficiary) is planned for release in February 2010 and is currently in post-production.

    there are hundreds of film having the same ‘title’. Titles are NOT copyrightable, not for films, books, songs, whatever. Specifically generic expressions like ‘birth of a song’ !!!!

    That doesn’t necessarily mean it’s a good idea to have the same title as already existing projects (?) but I cannot see problems using in this case ‘birth of a song’ if it doesn’t specifically ‘refer’ to, let’s say, a book with the same title.

    Check IMDB for films with same titles, just for fun.
